The main idea of the paper is based upon the assumption that justice as it is embodied in the rule of law is an inevitable prerequisite of social cooperation. Against this background the problems of post-communist societies are discussed.

In the paper possibilietes of compatibility of market, state and welfare are scrutinized. The author hopes to show that the often discussed dichotomy between market and state is false. Unintended consequences of the assimilation of welfare to the welfare state are pointed out.
